Outline and Purpose of the Course	刑法総論および各論の主要問題を取り上げ、主にドイツ法と英米法を比較する観点から判例・学説を研究する形で検討を進める。 ドイツ刑法・英米刑法の基本的な考え方に関する知識を身につけ、日本の刑法に対する理解をより深めることが授業の目的である。
Course Goals	・ドイツ刑法、英米刑法に関する知識や考え方を修得する。 ・日本の刑法について比較法的視点から分析する能力を身につける。
Schedule and Contents	毎回、報告者を決め、その報告を受けて議論を行う。報告に際しては、指定書物の要約のほか、日本の判例・学説の到達点をふまえた比較検討、さらには、各自の問題意識の提示が求められる。担当箇所は、第1回目の授業において決定する。 第1回　導入 第2回～第14回で取り上げるテーマの例（テーマによっては、複数の報告者を定め、1～3回にわたって行う） Omissions Preparatory offences Participation in crime Consent in the law relating to sexual offences Terrorism offences Proportionality of punishment in common law jurisdictions and in Germany Criminal history enhancements at sentencing Causation and Responsibility for Outcomes Imputation of Responsibility and Intoxicated Offending Crimes of Endangerment 第15回　フィードバック期間
Evaluation Methods and Policy	【評価方法】 平常点評価による。 　 【評価基準】 法政理論専攻履修規程第4条による。 法学研究科が定める成績評価の方針に従って到達目標の達成度を評価する。
Course Requirements	刑法の比較法研究に関心を有することを要件とする。
Study outside of Class (preparation and review)	授業前には、指定された部分を熟読したうえで、日本の刑法における同様の議論についても調べておくこと。 授業後は、授業で指定された文献に目を通すこと。
